Ay3ka : Embattled Assembly Members in Tarkwa Nsuaem serve notification to sue the Assembly



Lawyer for the twenty-two (22) aggrieved assembly members of the Tarkwa Nsuaem Municipality who were allegedly disenfranchised in the confirmation of the MCE for Tarkwa Nsuaem, Hon. Ben Kesse, has served a letter to the assembly declaring their intention to commence legal action against the assembly and the Municipal Chief Executive.

The 22 assembly members threatened legal action after they were prevented from taking part in the confirmation of the MCE in Tarkwa on Friday 22nd May 2020. They have thus gotten their lawyer to write to the Assembly to convey their intent to commence legal action against it, and the MCE.

The letter sighted by WGN is in compliance with Section 210 of the Local Government Act 2016 (Act 936).

“We are by this letter notifying you of our intention to commence legal action against the Assembly and the Municipal Assembly for the following reliefs; the purported meeting called to confirm the Municipal Chief Executive is procedurally illegal, null and void and of no effect; a declaration that the purported confirmation of the Municipal Chief Executive is illegal, null and void and of no effect; an order directed at Ben Kesse to vacate the office of the Municipal Chief Executive and not hold himself as being the Municipal Chief Executive for the Takwa Nsuaem Municipal Assembly; and any other reliefs that the court will deem fit,” the letter, signed by Lawyer Stephen Kwesi Kesse, stated.
